都市計畫圖為土地使用分區認定、建築線指 (示) 定、地籍分割及公共設施開闢等行政作業之重要依據,惟早期都市計畫圖常因圖紙老化、比例尺限制、坐標系統轉換及地形地物變遷等因素,致都市計畫圖、樁位圖、地籍圖與地形圖間產生不一致情形,形成都市計畫圖重製疑義。現行重製作業雖已建立圖資套疊及疑義分類機制,惟主管機關於面對重製疑義時,仍須進一步判斷應採何種界線作為重製依據、是否得逕為分割,以及是否涉及都市計畫內容之實質變動,其判斷過程涉及都市計畫歷程、土地權屬、既有行政處分、土地使用現況及公共利益等多重因素,尚缺乏系統化之決策架構。因此,本研究以「變更台東市主要計畫(計畫圖重製專案通盤檢討)案」為個案,採質性個案研究取向,以160件重製疑義案件為分析基礎,結合重製疑義圖冊、都市計畫書圖、相關法規與作業手冊、工作會議紀錄、參與觀察筆記及部分疑義研商逐字稿等資料,透過文件分析、案件比較與交叉比對,歸納主管機關於重製疑義處理過程中所考量之決策因子,並運用決策樹之條件式邏輯整理其判斷路徑。
研究結果顯示,都市計畫圖重製疑義之判斷並非單純依據圖資套疊結果,而係受到土地使用性質及個案脈絡影響,形成不同之決策因子組合與判斷順序。其中,道路用地案件主要考量道路系統完整性、計畫道路性質及土地使用現況;其他公共設施用地則著重都市計畫沿革與規劃原意、公共設施功能、土地權屬及管理需求;一般土地使用分區則較重視地籍權屬、既有建築使用、既有分割情形及人民權益。研究並發現,各項決策因子並非獨立作用,而係依案件條件形成具層次與先後關係之判斷路徑。據此,本研究將實務中較仰賴個案經驗與行政裁量之判斷過程,整理為具條件式邏輯之重製疑義判斷架構,並進一步釐清得以釐正方式處理、維持原都市計畫線逕為分割,以及涉及計畫內容實質調整而應循都市計畫變更程序辦理之不同情形,期能提升都市計畫圖重製疑義判斷之一致性、透明性及可追溯性,並作為後續相關實務作業之參考。
Urban planning documents and maps are important bases for land use control, cadastral subdivision, building line designation, and the development of public facilities. However, discrepancies among urban planning maps, stake maps, cadastral maps, and topographic maps may arise from historical mapping conditions, map deterioration, coordinate system transformation, and changes in physical features, creating issues that require professional and administrative judgment during Master-Plan Map Reproduction. This study identifies the decision factors and reasoning processes applied to such issues and develops a systematic framework for practical decision-making.
The Amendment to the Taitung City Master Plan (Special Overall Review for Master-Plan Map Reproduction) was selected as the case study. A total of 160 reproduction issue cases were analyzed through document analysis, participant observation, descriptive statistics, and decision-tree logic. The results show that different land use categories involve distinct decision factors and reasoning processes. Road land emphasizes the road system and existing development conditions; other public facility land focuses on planning history, original planning intent, facility functions, and land ownership; and general land use zones place greater emphasis on cadastral boundaries and established administrative actions. These factors operate sequentially rather than independently. Based on these findings, this study develops a conditional decision framework to improve the consistency, transparency, and traceability of decision-making in Master-Plan Map Reproduction.
