隨著國道路網日趨發達,高速公路道路工程主辦機關必須維持優良的服務品質,必須尋求解決人力有限的困難,保固契約是一種創新契約方式,藉由延長承包商的保固養護期限,鼓勵承包商以其經驗與專長,提供較長期且品質優良的施工成果。工程主辦機關將執行傳統契約監造工作的人力,轉為注意用路人實際感受的鋪面績效,承包商則將提供滿足傳統方法規範最低品質的供應者,改變為道路長期維護的參與者。
本研究以保固契約減少工程主辦機關人力、提高鋪面品質的樍神,檢視高速公路路面整修工程的契約範本,研擬試辦保固契約的契約草案,討論契約自預算編製、招標、施工、及保固的各階段,檢討保固契約運用於國內的可行性,並以配合現行法規及施工規範的前提,修訂傳統契約,使高速公路路面整修工程於開始試辦時,即能予以運用。
在保固契約的特訂項目中,5年的保固期是高速公路鋪面使用經驗上,可由承包商控制品質因素的合理年限。在鋪面損壞指標的討論中,對目前實際從事高速公路養護工作的資深工程司發出問卷,取得合理可在契約執行的門檻值及對應的修復作業。另外工程主辦機關應於保固期中辦理年度的鋪面績效評估,其績效指標以平整度、鋪面狀況調查及摩擦係數較能顯示對用路人的影響。在契約的一般項目中,則以目前使用的契約範本已可利用,僅需修訂保固年限自1年延長為5年,以及將保固保證金的額度自5%提高為10%,不需做大幅度修改。
契約草案的特訂條款,則將保固契約中,工程主辦機關及承包商雙方應辦理事項明確規定,並建立爭議處理小組做為雙方爭議事項的處理機制。
As the network of freeway in Taiwan extends steadily, the authority of freeway construction and maintenance should remain the highest level of service and resolve the difficulty about shortage of manpower. Warranty Contract is an innovative contract, which features the lengthening of the duration of guarantee maintenance by encouraging contractors to provide longer and better service after construction. The authority responsible for freeway construction will change from traditional role of monitoring the construction process to the monitor of the freeway users’ feelings about paving performance, and the contractors will transform from the traditional passive freeway service providers to the perpetual maintainer.
This research focuses on the elaboration of warranty contract, with the purpose of the reduction of the manpower in the authority of freeway maintenance and the raise of the paving quality, including the examination of the contract model of pavement maintenance, the draft of trial contract, the process from budgeting, calls for bidding and construction to maintenance, the practicability of warranty contract in Taiwan, and the amendment of traditional contracts on the basis of contemporary laws and construction requirements, in the hope that it can be applied to the trial freeway paving maintenance.
Among the specific items of warranty contract, 5-year guarantee maintenance duration of freeway paving is reasonable, in which the contractors can control the quality of the paving. There are questionaires sent to the senior engineers, who are working about the freeway pavement maintenance for many years, for the issue of pavement distress index, to get the reasonable thresholds for their corresponding repairing work. In addition, the authority of freeway construction should annually evaluate the performance, like smoothness, paving condition, friction factor, all of which may have more influence on the feelings of freeway users. As for the general items in the contract, the contract model in use is good enough. Except for the amendment of maintenance duration from 1 year to 5 years and the raise of guarantee money from 5% to 10%, no big amendment is necessary.
In the specialized items of the draft of warranty contract, between the authority of freeway construction and the contractor, the compulsory items on each side are stipulated and a conflict resolution team (CRT) is established to deal with ambiguous and disputing items.
