臺南市計有37個行政區,面積廣達2192平方公里,人口將近190萬人。自民國100年縣市合併升格為直轄市以來,各行政區整體開發步幅迅速,其中攸關民眾居住生活之建案及中央部會主導之大型地區開發案(如臺南歸仁沙崙智慧綠能科學城建設等)日漸激增,致相關建築管理業務日漸增加。工務局在配合中央主管機關之業務下其建管人力早已不堪負荷,又建築產業為民生經濟之火車頭與廣大人民生命財產息息相關,故如何運用有限之建管人力進行責任分工,進而達到最佳成效,提升民眾對政府施政的信心,為當前最刻不容緩的課題。
2016 年2 月6 日遭逢美濃大地震,當時永康區維冠金龍大樓,造成117 人罹難,為南投921 後最嚴重之地震。在後續的家園重建及責任歸屬釐清,也如排山 倒海而來。工務局作為本市建築主管機關其責任追究理當責無旁貸,在歷經監察院 彈劾案及國家賠償訴訟案中,均認為此案在行政流程上無疏失且就建築技術之審查 部分,係由建築師及專業工業技師簽證負責,足認無違法失職之處,基於行政技術分立原則,公部門委託第三公正單位辦理使用執照委外竣工查驗,確有執行之必要性。
目前國內六都直轄市除高雄市實行使用執照委外辦理竣工查驗及臺中市委託第三方辦理現場竣工查驗外,其餘各縣市政府仍是建管人員自行審查。臺南市自105年至109年間,每年核發使用執照數量有8成左右之案件,都是屬於建築物H類使用類組,為因應此龐大業務量,目前工務局已著手研議委託第三方專業團體來進行使用執照審查,吾人在使照審查業務已逾6年時間,約略了解民間業者及地方政府對於使用執照是否委外是有差異,希望能透過研究歸納出委外審查的課題與對策,以利後續臺南市使用執照委外的參考,並具體提出綜整適宜的委外審查可行性草案。
本研究透過第一階段的問卷,得知建築相關從業人員對於使用執照委外審查超過7成以上的贊成,且從其結果中獲得審查機制組成內容的主要意見後,經過第二階段專家訪談與第三階段專家問卷,確認規定項目看法與權重後,提出以建築物使用類組H類組(住宅類)為對象之「使用執照審查委託第三方單位之機制」,其內容包含「建築期限」、「人員資格」、「審查項目」、「審查費用」、「審查期限」及「監督機制」的規定與建議。最後,本研究針對使用執照委外審查的適用對象之擴大,提出未來之短、中、長期的實施計畫。
Tainan City has 37 administrative districts, covering an area of 2,192 square kilometers and a population of nearly 1.9 million. Since the merger and upgrading of counties and cities into municipalities in the Republic of China in 100 years, the overall development of each administrative region has been rapid. Among them, the construction projects related to the people’s living and living and the large-scale regional development projects led by the central government (such as Tainan Quyen Shalun Smart Green Energy Science City construction) is increasing rapidly, Leading to the increasing increase of related construction management business. The Works Bureau has long been overwhelmed by its construction and management manpower under the coordination of the business of the central competent authority,the construction estate is the locomotive of the people's livelihood and the economy is closely related to people's lives and property. Therefore, how to solve the problem of insufficient construction and management manpower is the most urgent issue at present.
The Mino Earthquake on February 6, 2016, at that time, the Weiguan Jinlong Building in Yongkang District killed 117 people. It was the worst earthquake in Nantou since 921. Subsequent home reconstruction and responsibilities are also overwhelming. As the government construction authority, the Public Works Bureau has an unshirkable responsibility for investigating its responsibilities. In the case of impeachment by the Supervisory Court and state compensation lawsuits, they all believed that there was no negligence in the administrative process of the case, and the review part of the construction technology was the responsibility of the architect and technician , and it was determined that there was no illegal or negligent duty.based on the principle of separation of administrative and skill, the public department entrusts a third impartial unit to handle the outsourcing inspection of the use license, and it is indeed necessary to implement it.
At present, except for Kaohsiung City’s implementation of the use license to conduct completion inspections and Taichung City entrusts a third party to conduct on-site completion inspections,other governments are still subject to self-review by construction management personnel. from 105 to 109 years in Tainan City, about 80% of the cases in which licenses were issued each year belonged to building class H use class group. to cope with this huge business volume, at present, the Bureau of Works has begun to discuss entrusting a third-party professional body to conduct the license review, I have been in the license review business for more than 6 years. I understand that there are differences between builders and the government on whether the license is outsourced. I hope that through researching out the issues and countermeasures for outsourcing review, it will benefit the follow-up Tainan City's use of license outsourcing reference,propose a suitable feasibility draft for outsourced review.
Through the first stage of the questionnaire , this study found that more than 70% of the construction-related practitioners agree with the outsourcing review of the building use permits. And from this result,we can obtain the necessary components of the Outsourcing Review mechanism. Then after the second stage of expert interviews and the third stage of AHP questionnaires, confirming the importance and feasibility of each item,a preliminary plan for the Outsourcing Review system for the building use permits of the collective housing in Tainan City is proposed. The content includes the regulations and suggestions of "construction period- Handle in accordance with the Building Act ", "personnel qualification- Member with more than 5 years of experience ", "review item- Implemented in accordance with the executive manual of the building use permits by Tainan City ", "review fee- The two charging modes, namely, the fixed inspection fee and the fixed inspection fee, are paralleled by the project cost range ", "review period- Handle in accordance with the Building Act " and "supervision mechanism-Set up public complaint method , Public construction dispatched construction management personnel review and determine the mode of implementation of random inspections". Finally, this research proposes short-range, medium-range, and long-range implementation plans for the expansion of the scope of outsourcing review of licenses .
