我國自1999年正式施行科學技術基本法，開始允許公營學研機構可將研發成果之智慧財產權下放至各單位。國內幾所大學也在國科會的協助下於2000年起紛紛設置智權管理專責單位，並制定校內各項規章，將成果歸屬明確化、保護並加強推廣全體教職員生的研發成果、並建立將成果技術移轉至企業的機制。科技基本法施行至今剛屆滿十年，各界對於大學智慧財產權的保護和運用情況，尤其是對技術移轉績效的評估機制，有許多不同見解。究竟「專利保護」是不是影響「技術移轉績效」的必要或重要因素？本研究藉由包含國立成功大學在內的四所大學智權管理單位所提供的各項數值資料，經過客觀的統計分析後加以解讀，來彰顯我國大學自科技基本法施行後的真實狀況，說明實際情況和一般認知之間的差異。本研究彙整以下發現：
一、國內外學術界大多數的學者專家，認為技術有專利保護是促成技術移轉的一大因素。但本研究發現事實上，過去數年來我國大學研發成果之專利保護並不是影響技術移轉績效的必要或重要因素。
二、國立大學在技術移轉績效的整體表現上，是以『不含專利保護』情況比『有專利保護』者較佳，但私立大學卻主要是在取得專利之後再進行技術推廣及授權。不過當扣除專利成本後再進行技轉效益評估時發現，不分公私立大學，假如只一味推行專利授權模式，各大學在經營智財權管理及運用這上面，都會持續虧損。
三、成功大學工程類的技術以專利授權的成效不佳，幸好有累積夠多的Know-how案例才能轉虧為盈；而在生技醫藥類的技術領域，授權標的幾乎全是Know-how。這兩點與一般認知差異很大！

Since the enforcement of Science and Technology Basic Act in 1999 becomes effective, the government-owned research and academic institutes are allowed to own the intellectual property rights (IPR) from their research results. Under the assistance of National Science Council, several domestic universities have established dedicated IPR management offices to protect the IPR results, promote IPR and institutionalize the technological transfer mechanism since 2000. It has been 10 years since the enforcement of Science and Technology Basic Act activated. Up to date, it becomes apparent that different views exist on how the universities protect and utilize the IPR results, particularly the evaluation mechanism on technology licensing to be more effective and efficient.
Is patent protection in general a necessary or important factor of performance on technology licensing? By analyzing the statistical data from four IP management offices within four universities including NCKU, this research explains the difference between practical situation and general perception. The research has the following findings:
1.Even though most scholars and experts believe that patent protection is a key to technology licensing, however this research finds that patent protection of domestic universities is, in fact, not a necessary or important factor of performance on technology licensing.
2.The overall performance on technology licensing of public universities shows that cases without patent protection are better than that with patent protection, while the private universities undertake technological promotion and licensing after acquiring patents. After deducting the patent management costs, public or private universities will continue to suffer losses if they only undertake technology licensing model.
3.NCKU’s engineering technology does not show good performance in terms of patent protection. Fortunately, NCKU has accumulated enough cases of Know-how’s, which have made profits out of the costs in the end. In biotechnological and pharmaceutical areas, the targets of technology licensing are almost Know-how’s. These above two points are quite different from general perceptions.
