達文西機械手臂，一個獨佔市場20年的機器人輔助外科手術的產品，從1997年到2019年間研發約5200個相關專利，因有著專利的保障，成為潛在競爭對手進入機器人手術市場的障礙。機器人手術系統非常複雜，需經過多年才能開發及美國FDA批准程序通過後才能使用，根據TrendForce最新生物科技報告指出，2016~2021年機器人手術複合成長率（CAGR）高達19.3%。面對醫藥產品的專利到期、市場的開放及其他競爭者的相繼進入或，許是市場變動的一大隱憂，該公司如何調整其經營策略，是本論文的主要研究目的。論文採用質性研究方法，訪談於醫藥市場上經驗豐富之專業經理人，並藉由資料分析並結合經營策略理論、動態競爭理論、五力分析各個關鍵因素來歸納出專利期後經營策略的成功因素。分析結果包含產品的完整性、客戶的差異化服務及公司人才的挑選等，公司也必須不斷開發新的客戶，擴大原有市場，均是利於築高競爭者進入屏障的防守策略，也是擴大目前市場上的市占率及滲透率的積極策略。研究者在文獻回顧中發現，過去研究於醫藥市場專利期過後的探討，均是由藥品角度切入，目前尚無與醫療器材專利到期後的文獻可供參考。本研究結果期許能提供醫材商面臨專利期後，市場即將面對競爭者的出現如何以實務可行的經營策略應對。

Da Vinci system is a robot-assisted surgical product that has been in the Monopolistic market for 20 years. The patent will expire soon and the market is opened. More competitors entered this market and how to adjust the business strategies. This is a qualitative research and conducted with interviews with experienced professional managers in the pharmaceutical market, and data analysis combined with business strategy theory, dynamic competition theory, and Porter five forces analysis. Then, we can analyze each key factor and summarize the success of post-patent business strategy which includes the completeness of the product, the customer’s differentiated services, and the selection of company’s talents. All of these can help us to consolidating the market. The company must also attract new customers and expand the market share. The results of study can help medical materials vendors whose patent period will expire to develop practical and feasible business strategies in competitive market in Taiwan.
