自2002年台灣加入國際貿易組織(WTO)以來，傳統的農業生產受到了威脅，也帶來了農業轉型成為休閒農業，提升附加價值的契機。由於休閒農場的設立過程中主管單位繁多，除造成合法經營及管理上的困難，更因缺乏整體控管機制形成土地管理的漏洞，造成難以維持農地的困境。而現階段休閒農場中的休閒遊憩活動及休閒農業設施，與農場經營無關或衝突，是否合乎農業與休閒農業之發展理念，也成為一值得探討之議題。

本研究嘗試休閒農業改採行開發許可之方向，對於休閒農場在農地利用所面臨的課題提出對策，以促使休閒農業合法化，促進休閒農業朝合理之經營方向發展，增進產業競爭優勢，並對環境品質提升有所助益。藉由研究得到下列成果：

一、休閒農場土地利用與農業土地之關係
確立「休閒農業」為農業之一部分，休閒農場依其使用可概分為；原有之農業生產，及附屬於休閒農場設立所增加的休閒遊憩。在土地管理方面，原有之農業生產本即為農業土地所容許；而休閒農場設立所增加的休閒遊憩，非屬原農業用地所容許，乃是欲達成農業生產、休閒生活、生態保育之農業三生環境的永續農業的政策目標之作為，應藉由審議，決議其是否適當之部分。休閒農業與休閒農業設施在土地利用上，不論在開發規模與利用方式應維持在農業之範疇，為農業用地所容許使用。

二、獲知現階段休閒農場設立過程中所面臨之困境
1)業者對設施設置法令上的限制缺乏認同；2)法規繁瑣缺乏相同標準與輔導；3)申請程序與時程冗長繁瑣；4)申請中所需花費過高；5)審查未符合土地管制理念；6)現行之設施項目不符農業與休閒農業發展需求。

三、開發許可制度運用於休閒農場開發管理之可行性
為有效管理休閒農業之發展與維持農地之合理使用，藉由現行都市土地與非都市土地之開發許可審查，審查休閒農場之土地開發利用。將土地開發之審查權責回歸開發許可審議機關，就其土地開發之專業審理。建立審理部門與申請者、輔導者的雙向對話，並藉此獲得較為客觀、公平之審議結果。

四、休閒農場開發許可制度的建立
由現階段都市與非都市土地開發許可之制度體系建構，在不違反現行開發許可制度相關規定的原則下，針對休閒農業之特性做制度上的研擬。

The traditional Agriculture has been threatened with its production since Taiwan joined WTO in 2002, the matter which makes agriculture become leisure use of agriculture land to elevate the opportunity of the additional value. In addition, there is the difficulty in legal conduct and management because of many director organizations during the setting procedures of leisure of Agriculture. Besides, the disadvantage of lacking the completed mechanism to control the form of land management is hard to sustain the farm. Nowadays, whether having no relationship or challenging between leisure recreation activity and leisure facilities of agricultural in Leisure farm and farm management is correspond to the development idealism of agriculture and leisure of agriculture or not, the idealism has become to command the topic for discussion.

Therefore, the author tries the application to make up of a system of the Planning Permission as the strategy to solve the problem which mentioned above. The Planning Permission of agriculture land can not only use for land use legalization but development the reasonable management in order to increase the advantages of local competition. Moreover, it is also helpful to elevate environmental quality. The consequences by the study as follows to be conclusions:

1. The relationship between the land utilization for leisure use and agricultural Land-
For the reason of the original production of Leisure Farm which is to be identified under the management of agricultural department and the leisure function of the land should be regarded as an attached approval additionally. That is, Leisure Farm should be admitted by Land of Agriculture, in order to fulfill its management necessary and achieve its sustainability.

2. The difficulties are obtained during the setting procedures:
a. The installment procedures of Leisure Farm are not able to be realized by proprietors
b. The regulations and laws do not follow the same standards and guidance which to be practiced
c. The duration of procedure petition is time-consuming.
d. The duration of procedure petition is highly-cost.
e. The examination is not corresponded to the idealism of land management.
f. The items listed for Leisure Farm installment are not corresponded with the developmental need of agriculture and leisure use.

3. The feasibility of Developing Permitting System which to be made use of developing management on Leisure Farm-
In order to manage the development of Leisure of Agriculture effectively and maintain the use of farm reasonably, we can examine the Land Development of Leisure Farm by the Planning Permission Examination of urban or non-urban land development standards. That the author suggests to turning to the examination authority, Bureau of Planning Permission, for land development examination of Land Development in especially. That is for the guarantee of an impersonal and fair examination by the mutual conversation of applicants and assistants.

4. The establishment of developing permitting standards on Leisure Farm-
The author suggests that the policy-planners should be aware of the characteristic of agricultural land systematically which is to setup the development-permitting standards for practical operation.
