合法下載數位著作物的使用人，看似對該數位檔案取得充分支配地位，實則必須警惕，數位傳輸行為涉及重製，使用人原則上無權為之，否則恐侵害著作權人受著作權法保障的獨占權利。
傳統上用於調和有形體著作物所有權人與著作權人間利益的散布權耗盡原則，有無適用於數位著作物的空間，進而劃下合法傳輸界線？除有體與無體間差異，授權取代銷售的交易模式、傳輸過程中不可避免的重製行為，與就散布權耗盡原則採取地域性限制的立法例，均是欲於數位交易環境適用權利耗盡原則，必須突破的疑難。尤其，透過網路隨選互動模式供大眾近用著作的行為，於我國著作權法，構成公開傳輸──不屬權利耗盡範疇。
經由研析美歐判決與學說見解，確立本文核心想法──「傳輸過程中不可避免的重製」係肯認數位耗盡的最大障礙。本文嘗試尋求於我國對數位傳輸著作物適用散布權耗盡原則的解方，發現難以對所有類型數位著作物開放試用，否則對著作權人衝擊過劇。退而求其次，探尋能否小範圍地對特定數位著作物適用之，並以數位學術期刊文獻為例，行個案探討；較保守地，得出否定見解。
對部分類型數位著作物開放適用散布權耗盡，恐割裂整體原則性；尚不宜通過散布權耗盡原則，為數位傳輸劃下合法界線。惟通過個別著作財產權限制條款之適用或增訂，於特定情狀下，數位傳輸非無合法空間。

The exhaustion doctrine is traditionally used to reconcile the interests of owners of tangible works and copyright owners. Whether it can be applied to digital copyrighted lawful copies, thereby drawing the boundaries of legal transmission, is still in dispute. Aside from the distinctions between tangible and intangible copies, the shift from sale to licensing, the unavoidable reproduction during transmission, and the territorial restrictions imposed by legislation on the exhaustion of distribution rights are all significant challenges that must be addressed to assert the applicability of the exhaustion principle to digital transmissions. Particularly, under the Copyright Act of Taiwan, making a work available to the public, allowing individuals to access the content at a time or place of their choosing, constitutes public transmission, which does not fall within the scope of the exhaustion doctrine.
After analyzing judgments and doctrinal insights of the US and Europe, the core idea of this thesis is established that "inevitable reproduction during the transmission process" is the biggest obstacle to the recognition of digital exhaustion. This thesis seeks a solution in Taiwan for applying the exhaustion doctrine to digital transmissions of works. It finds it challenging to extend this application to all types of digital works, as doing so would excessively impact copyright holders. As a compromise, the thesis explores limited application to specific digital works, using digital academic journal articles as a case study, but concludes conservatively against it.
