我國自 2016 年推行能源轉型政策,並以離岸風電作為主要策略項目。在離岸風電規劃上,經濟部透過三階段政策(示範獎勵、潛力場址與區塊開發)部署風場場址,並以彰化海域為主要案場所在。而為因應離岸風場規劃對於既有海域使用的影響,交通部航港局亦公告了彰化風場航道及其航行指南,以律定彰化海域之船舶航行秩序。然而,除了離岸風場本身招致既有漁業使用者的批評外,航行指南一經發布即引發漁民質疑指南內有關漁船禁漁、禁航之措施,並經由臺中、彰化與雲林等地高達201位地方漁民,委託法律扶助團體向行政院提起行政訴願,以爭取既有捕撈與航行權利。
綜觀國內海域使用衝突的相關研究中,多表明了離岸風場設置對於傳統漁業所造成的潛在時空影響;部分研究則從離岸風電政策與法制本身,探討制度安排的矛盾與法律基礎的不穩定,對於離岸風電開發的影響。儘管法律與政策事務學者試圖突顯法律與空間的聯繫,海域使用關係與衝突在這其中卻被化約為單純的法律問題,從而忽略了社會衝突中各行動者的主體性與社會權力結構。此外,當前國家公正轉型行動計畫亦指出離岸風電政策在權益關係人界定及其協助方面,仍有方法論或知識的缺口。因此,本研究透過法律地理學者Delaney (2010) 的規範圈理論回應上述議題,並以彰化風場與航道事件為個案,旨在探討彰化沿近海漁民主張的使用權利(捕撈與航行權利)如何與我國沿近海法律和空間相互構成?
本研究在個案研究之方法論選擇下,以彰化風場與航道事件為個案,並透過文件回顧、分析與深度訪談進行資料蒐集與分析。在研究結果上,本文指出擾動後的漁業使用面臨了高度重疊與複雜的規範痕跡重構,這將導致離岸風場與中、小型漁船(筏)之間的潛在衝突發生。此外,在國家能源轉型政策下,航業使用與漁業使用主管機關相繼在海域空間秩序重組下妥協,在話語競逐中落居下風,而不利於整體使用秩序之調和。因此,在離岸風場與航道內部的漁業使用,除了主管機關間的薄弱共識外,尚須倚靠漁民–漁會–風電廠商間的共識與默契,以及在規範技術人員的協助下透過法律程序得到體制上的回應。綜上所述,本研究詳述了海域使用衝突議題中法律與空間的關係性與行動者的主體性,補足國內相關研究之缺口。同時,於法律地理學取徑下拓展海洋場域應用,提供未來研究發展之可能。
Since 2016, the Taiwanese government has actively promoted energy transition policies, leading to disruptions for coastal and offshore fishermen in Changhua caused by offshore wind farms and channel. These developments have impacted fishermen’s rights to access and use marine resources. Previous research has largely overlooked the agency of stakeholders and the influence of social power structures in marine spatial conflicts. Moreover, the current National Just Transition Action Plan has acknowledged shortcomings in identifying stakeholders in offshore wind power policy. In response, this research adopts legal geographer Delaney’s (2010) theory of nomosphere to address these issues.
This research selects the Changhua offshore wind farm and channel as a case study, employing a qualitative methodology to collect and analysis soft data. The findings highlight that the wind farms-fishermen conflicts stem from overlapping nomospheric traces and fundamentally different relations to the sea. It also draws attention to the discursive contestations among actors in marine spatial conflicts—particularly the negotiations between government agencies; the informal consensus and tacit understandings between fishermen, fishery associations, and wind power developers; and the role of nomospheric technicians in navigating legal procedures. In sum, this research emphasizes the agency of actors in maritime spatial conflicts and extends the applicability of legal geography to the ocean.
