本研究是從空氣污染糾紛的應變政策取向出發，針對大發工業區空氣污染案例進行研究，探討空污事件發生時之政府糾紛應變機制的處置過程和實際執行情形。根據本文之研究發現，中央政府可能因太早介入公害糾紛，遭誤認係中央之責，事後雖釐清，但成效不佳、監督及溝通應變機制也亦不健全。理由在於空污法與公害糾紛處理法均規定，地方政府係處理空污事件之主角，應主動進行空污之調查與處理。然而，地方政府未能落實污染之監測及稽查並且未及時啟動紓處、調處作業，使得爭議擴大。再者，工業局大發工業區服務中心則是因空污訊息通報延遲、平時緊急應變準備作業不足、未積極啟動公糾紓處與調處遭到監察院糾正，主要就是空污案件並非服務中心的重要業務。
最後，整理本文中所得到的研究發現，歸納後續進行糾紛應變機制政策時的建議，包括應參考將更多居民的意見納入以避免抗爭事件出現；政府各個不同部門的整合，分工調配各單位的職責，也就是中央必須視情況協助和監督地方，使地方能主動出面處理並且配合中央的運作；另外，再加上學術界的力量、舉證責任反轉提出之時機等，並且針對「污染查緝」、「糾紛應變機制」、以及「溝通協調」部分，提出幾點革新建議與方向。

This study is from the air pollution disputed reaction policy direction, to research in the Dafa industrial park, to discuss when the air pollution event occurs, the government’s disputed reaction mechanism of process and the practical implementation, hoping to provide policy-oriented analysis of a complete and effective solution with strategy recommendations for environmental protection agencies that similar pollution incidents occurred in the future. According to the research discovered in this study, because the central government was too early to intervene the public nuisance disputes, it was mistaken the responsibility, although it clarified later, the results were not good, supervision and communication mechanism were also inadequate. The reason was that the local government was the leading role of the air pollution incident, and it should handle the air pollution event and investigate actively. However, the local government failed to implement pollution monitoring and inspection and didn’t start the mediation operation in time, making the dispute expanded. And then, the Dafa Industrial Parks Service Center of the IDB was corrected by the Control Yuan because of the air pollution notification delayed, the standard operation and the mediation process was defective, and didn’t actively start the mediation operation, then it was the main reason that the air pollution cases wasn’t the important business of the Dafa Industrial Parks Service Center.
Finally, arranged the research discovered in this article, and induced the follow-up recommendations of the disputed mechanism policy, including more opinions of residents to avoid the controversy happening, the integration of various government departments, that is the central unit have to assist and monitor the local unit, so that the local unit can handle the incident actively and operate in coordination with the central unit. In addition, combined strength of the academia, the timing to propose of reverse burden of proof, then making a few suggestions and direction of innovation for "pollution cracked", "disputed reaction mechanism", and "communication and coordination" in follow-up study suggestions.
