  • 本文以開放銀行制度下消費者金融資料保護為研究核心,聚焦於資料可攜性與互通標準兩項議題,探討我國現行個人資料保護及金融監理法制,能否使消費者有效控制、移轉及管理其金融資料,並檢驗由產業主導之技術標準是否足以達成跨機構資料互通與公平競爭。本文採取文獻分析法、比較法研究法及歸納研究法,選取歐盟、英國、香港與新加坡為比較對象,分別觀察各法域在規範介入時點、規範強制性、資料可攜權及標準制定主導模式上的制度差異,並據以評析台灣自願自律委外模式之法制缺口。

    研究結果顯示,開放銀行欲實現消費者賦權,不能僅在形式上賦予消費者資料可攜權,尚須確保資料互通標準得以建立,使消費者及其指定之服務提供者具備公平接取可利用、可讀及機器可處理資料之基礎;同時,亦須提供易於操作的授權管理工具,使消費者得持續監督資料流向、掌握授權範圍並隨時撤回同意。唯有法律權利、互通標準及持續授權管理三者相互配合,始能形成穩定、持續且可供創新服務利用之資料基礎。比較法觀察顯示,歐盟採取權利導向、全面強制及機關主導標準之模式;英國以競爭法命令結合準自律標準制定;香港由自律逐步轉向公部門主導之基礎設施與義務規範;新加坡則採機關設框、市場填充、基礎設施主導,並以資料可攜義務補強。各法域雖採取不同路徑,整體上均呈現強化事前監理、制度化授權管理及確認資料可攜義務之趨勢。

    相較之下,台灣由財金公司建置之OPEN API規範及Fast-ID轉接中心,已具備相當程度之技術互通基礎;然而,個資法尚未明文賦予資料可攜權,消費者僅享有靜態查詢與複製權。現行授權流程亦存在「授予集中、撤回分散」之不對稱,且技術標準主要由銀行業者及財金公司制定,欠缺TSP業者與消費者代表之制度性參與。台灣制度因此呈現「技術基礎相對完備、直接法律賦權不足」之結構性落差。

    本文建議,近期應由金管會核准擴充Fast-ID轉接中心,使其提供統一之授權狀態查詢、授權範圍顯示、即時撤回同意及授權紀錄保存功能,以降低消費者管理成本;遠期則應修正個資法,明文增訂資料可攜權,要求資料控管者依當事人請求,以結構化、通用且機器可讀之格式提供資料,並於技術可行時直接傳輸予指定之其他控管者。同時,應由個資保護與金融監理機關共同訂定金融資料範圍、技術格式、移轉程序及責任機制,使技術互通、消費者自主與市場競爭相互配合,建立兼顧資料保護與金融創新之開放銀行法制。

    Open banking enables authorized third-party service providers to access consumer financial data through application programming interfaces. Formally granting consumers a right to data portability, however, does not by itself produce meaningful empowerment. Interoperability standards must also provide a foundation for fair access to usable, readable, and machine-processable data, while user-friendly permission-management tools must enable consumers to continuously monitor data flows, control the scope of authorization, and revoke access. Only this combination can sustain reliable data flows for innovative services. This thesis compares the European Union, the United Kingdom, Hong Kong, and Singapore and evaluates Taiwan's voluntary, industry-led model. It finds that Taiwan has developed an advanced technical foundation through its OPEN API rules and the Financial Fast Identity Online platform, but does not expressly recognize data portability or provide unified permission management. Standard setting also remains dominated by incumbent banks and the Financial Information Service Co. This thesis proposes expanding Fast-ID into a centralized platform through which consumers can review and revoke authorizations, followed by amending Taiwan's Personal Data Protection Act to establish a right to receive and transmit data in a structured, commonly used, and machine-readable format. These reforms would integrate enforceable rights, technical interoperability, and continuing consumer control.
