在科技進步與生物技術的日新月異下，人類的健康觀念已經從疾病的治療改觀成為疾病預防。基因檢測、精準醫療、數位醫療等已成為全球生醫產業的重點趨勢。台灣具備優良的醫療體系、健保資料庫數據及ICT技術可應用於生醫產業上，使我國生技醫藥產業有望成為具國際競爭力之產業。在國家政策不斷推動之下，產業快速發展同時也需要相關法規的跟進；因生醫產業特性屬於價值鏈長、初期投資金額大，且與人民生命安全相關因此受到高度的法規監管，但許多新創團隊因資源不足無法投入人才與資源在法規監理這一部分，使創業過程更為艱辛。
本研究採取質性研究方法，資料來源使用次級資料與多重個案訪談。首先第二、三章梳理我國生醫產業的發展過程與脈絡，透過產業發展歷史可知悉政府的扶植政策方案及相關的法規沿革原因，但僅透過法規梳理無法瞭解目前我國法規的適用性或是不足之處，因此本研究選取了四個國內生醫產業的實際爭議案例評析說明，以個案探討國內法規的爭議判決或提供建議，給予立法者及新創團隊更多思考的方向。最後以個案訪談方式回歸產業面，針對實際運作的新創企業進行個案訪談，以彙整總結。
新創生醫企業分兩類，其一為學研機構出身、另一為大企業多角化的新創子公司。本研究結果發現，第一類新創企業資源較少，不會優先將資源投入在法規人才上，但若有基本的法規認知在創業過程遇到的阻礙會較少，隨著新創發展階段不同對於法規認知的重視程度也會不同，另外雖政府有在扶植生醫產業但在產業中具備即戰能力的法規人才依舊稀缺，目前已有不少大專院校有相關課程培育，但業界仍希望未來能更系統化的培育生醫產業的法規人才。未來的研究方向也可朝針對單一生醫領域做更深入的個案訪談，對多個企業進行訪談也可以獲得更多元的意見避免缺乏產業代表性的回答。

With the rapid development of science and technology and biotechnology, the concept of human health has changed from disease treatment to prevention. Genetic testing, precision medicine, digital medicine, etc. have become key trends in the global biomedical industry. Taiwan has an excellent medical system, complete health insurance database, and ICT technology can be applied to the biomedical industry. Under the continuous promotion of national policies, the industry also needs to follow up with relevant laws and regulations; Because the biomedical industry has a long value chain, a large investment amount, and is related to people's life safety, it is subject to a high degree of regulatory supervision, but many start-up teams are unable to invest talents and resources in the part of regulatory supervision due to insufficient resources.

The results of this study show that there are two types of new businesses, one is from academic research institutions, and the other is the diversified new subsidiaries of large enterprises. The first type of start-up enterprises has fewer resources, will not give priority to the investment of resources in the regulatory talents, but if there is basic regulatory cognition in the entrepreneurial process will encounter fewer obstacles, with the development stage of the new venture different attention to the degree of legal cognition will be different, and although the government is supporting the biomedical industry but in the industry with immediate combat ability of regulatory talents is still scarce, at present many colleges and universities have relevant courses to cultivate, but the industry still hopes to more systematically cultivate the legal talents of the biomedical industry in the future. In the future, the research direction can also be towards more in-depth case interviews in the field of single biomedicine, and interviews with multiple companies can also obtain more diverse opinions to avoid lack of industry representative answers.
