早期我國農業發展以農業生產為主題的發展模式，到後期因受到整體經濟發展與加入WTO的影響，我國休耕農地逐漸攀升，農業轉為多角化的農業經營模式，農地不再單純為生產功能，並兼具了生活與生態等功能。我國農業發展條例也在經濟政策之影響之下，由「農地農有，農地農用」至「放寬農地農有、落實農地農用」，同時改變了整體的農業經濟結構，並設「農業用地興建農舍辦法」及「集村農舍」、「農地違規使用獎勵制度」，卻未有完善的農業用地規劃配套措施之下，農舍逐漸林立於綠野鄉間，並產生了「假農舍真豪宅」與「狗籠舍」…等問題。而國內老人趨向於與子女同住並重視家庭和諧。會選擇居住老人住宅會照護機構之人士，屬收入較高子女數少的白領階級。雖我國政府運用民間的力量推動老人住宅照護機構，塑造了環境優美、設施齊備之居住環境，但其收費標準過高，使一般民眾望之卻步。加上近年來掀起的島內移民潮，不僅國人喜愛臺灣富有的鄉間田遠景致，也吸引了不少外國客來臺居住。雖「農舍」市場龐大，但政府卻未能修正農地利用等相關法令，農地規劃也一直未受到真正的重視，導致農民雖能興建農舍使用，但卻背負著破壞田園風光的罪名。本研究將分析我國農地政策與現有農業用地興建農舍制度，並探討我國農地農舍所產生之轉變，與現今社會大眾對於農舍之觀感。並試圖以一農牧用地之基地為個案開發研究，調和其中之衝突，並使農地恢復其真正價值。

Our nation’s early agricultural development focuses on production. With WTO membership and economic development, the amount of fallow land in our nation increases slowly while agricultural diversification takes place. Farmland is being used not only for production but also for everyday living and ecology. Under the changing economic policy, our nation’s agricultural law also changes from “Farmer’s Farmland, Farmland Farming” to “Widening Farmer’s Farmland, Executing Farmland Farming,” changing the fabric of agricultural economy. In addition, “Method of Farmhouse Construction on Farmland,” “Farmland Neighborhood,” “Illegal Use of Farmland Reward System” were also incorporated into agricultural law. Without proper planning of agricultural land use, farmhouses are being built in the countryside, creating problems including “Fake Farmhouses, Real Mansion” and “Dog Houses.” Nationwide, senior citizens favor living with their children and value family harmony. Individuals who live in senior residential organization instead of living with their children belong to the small white-collar worker population, which has higher income and fewer children. Even though our nation attempts to use social forces to promote senior residential organization by creating an image of a well-equipped and peaceful environment, the high cost of living in senior residential organization prevents the idea from gaining popularity among the society. In addition, a recent increase in immigration shows that not only native inhabitants like the unique Taiwanese countryside but foreigners as
well. While a huge market exists for “farmhouses,” the government has not yet been able to properly modify farmland usage laws and does not value the importance of farmland planning. As a result, farmers are unable to build farmhouse for farming usage while carrying the blame for destroying the countryside. The present study analyzes our nation’s agricultural law and the current farmhouse building laws, investigates the changes due to our nation’s farmland and farmhouses, and discusses societal views on farmhouses. Using Tainan Sin-Hua district as case study, the study tries to reconcile the conflicts involved and restore the values of farmland.
