營建工程之執行，由甲乙雙方簽訂契約，依約定內容履行權利義務，契約及規範條款為執行工程時，權利義務、行政程序、專案管理及技術要求的基礎及標準。隨著工程參與者對契約的權利意識高漲，契約內容與條款之重要性隨之增加，一套合理的契約文件，讓執行契約的各方了解及正確使用，實有必要。
　　一般而言，施工契約文件可分為四個部份：一般及特別契約條款、一般及技術規範、圖、其他文件與附件等，其中一般契約條款訂出法律上的權利義務事項，一般規範訂出施工行政與管理的一般要求，而技術規範規定施工技術與材料方面的標準。國內實務上使用這些文件時，常有不清楚、內容重疊及錯置情況，尤其對一般契約條款及一般規範。
　　公共工程委員會所頒之公共工程施工綱要規範，以美國施工規範協會(CSI) 1995年出版之 Masterformat 為其架構而編排，例如01篇之一般要求對行政管理做出規定，但第00700章一般條款又參考國際顧問工程師協會(FIDIC) 的施工契約條款，此兩者來自不同背景，在內容及編排上有所不一致、重覆、權利義務條款與作法程序規定錯置等問題。
　　本研究目的是探討00700一般條款及01篇一般要求的內容，及工程會施工綱要規範於此有關篇章的架構，釐清此等條款的內容及正確編排。研究方法從法律權利義務、法規行政及專案管理、實體與程序等角度切入，分析比較 FIDIC 契約條款、 Masterformat 2004的篇章架構、美國建築師協會(AIA)的契約條款，找出具體適當的歸類，提供工程會施工綱要規範之修正建議。

　　Both the owner and contractor implement right and obligation according to the contract. The Contract Conditions and Specifications are the foundation and standard of legal right and obligation, contract administration, project management, and technical requirement when executing work. Because contract parties’ consciousness about rights is rising, the importance of contract documents and contents is growing. It is necessary to establish adequate contract documents and reasonable content for the parties to understand and use properly.
　　Generally speaking, contractual documents can be divided into four parts: (1) General and Special Conditions, (2) General and Technical Specifications, (3) Drawings, and (4) Appendices and other documents. The General Conditions specify the contractual relationship and legal obligations of parties, whereas the General Specifications regulate management and procedural requirements. Technical Specification specifies material standards and workmanship. However, these document contents are unclear, overlapping or misplaced when used in Taiwan, especially the confusion between General Conditions and General Specifications.
　　The construction specifications issued by The Public Construction Commission (PCC) are arranged on the basis of MasterFormat 1995 Edition of American Construction Specification Institute (CSI). For example, Division 01 General Requirements specify administrative management, but section 00700 General Conditions refer to General Conditions published by FIDIC. Owing to different systems, there is inconsistency, repetition, and disorder in the content and arrangement between General Conditions and General Requirements.
　　The propose of this research is to explore and clarify the content and arrangement of section 00700 General Conditions, Division 01 General Requirements of the PCC’s Public Work Construction Specifications. This research mainly analyzed and compared FIDIC Conditions, MasterFormat 2004 Edition and AIA-A201 General Conditions concerning legal right and obligation, administration, management, and reality. Appropriate contents and arrangement are identified that can be adopted by PCC for revising its construction Specifications.
