摘要
　　本研究從政治經濟學及女性主義的角度出發，審視台灣與瑞典的母性保護及兒童照顧政策的發展過程，及法令的完整性與其內容之差異。本研究發現，台灣與瑞典在母性保護制度的項目上大致相同，然而在其福利內容方面，則有兩大差異：政府是否給予津貼補助的差別，以及假期是否為特殊假，或歸類為事假等一般假期的差異。根本來說，這樣的差異來自於兩國是否將母性保護精神落實在法令當中。

　　從政治經濟學面向來看，基於追求立即的經濟成長效果，及財政排擠因素等考量下，台灣政府對於提昇母性保護及兒童照顧政策內涵與效用，傾向保留、延後或取消的態度。瑞典則是致力於建立兼顧母性保護與經濟發展的制度環境。

　　從女性主義角度看來看，台灣較強調訂定保障母性權益及兒童照顧之法令，因此較接近自由主義女性主義的主張，而在實質保護內容及法令的施行上，卻難以落實當初立法的原意。而瑞典則由於其公部門介入支持母職，保護母性，並提供公共的托兒設施，較符合社會主義女性主義的立場。另外，在兩性共同負擔照顧責任上，瑞典政府所扮演的角色顯然較台灣政府積極得多。

　　除此之外，台灣與瑞典的母性保護及兒童照顧法令除了內容上及實行上的實質差異外，另有瑞典的「社會共識引導制度的建立」或台灣的「制度引導社會意識的建立」的差異，此差異也導致了兩國在制定相關規定內容及實行上之分歧現象。

Abstract

　　This study testifies the developing process of Taiwan and Sweden’s Motherhood Protection and childcare policies from the point of view of Political Economics and Feminism, and the difference between the completeness and contents of two countries’ laws. This study found that most of the Motherhood Protection systems in Taiwan and Sweden are the same, but have two major differences in the contents of welfare: whether the government give applicants subsidies or not, and whether the parental days are special vocations or not. Fundamentally speaking, these diversities came from the different complete levels in which the two countries practice the spirit of Motherhood Protection into their laws.

　　From the aspect of Political Economics, considering the chasing of economics growth and the financial edge out factors, Taiwan’s government had an attitude to retain, postpone, or even cancel the practically action to improve or enforce the contents of those Motherhood relative regulations. Sweden devoted to build a complete circumstance that gave consideration to both Motherhood Protection and economics growth.

　　From the aspect of Feminism, Taiwan stressed on legislating laws which protect mothers’ rights and childcare, so it appeared to be close to liberal Feminism. But Taiwan couldn’t take the original spirits of laws into practice in the real contents and the enforcement of laws. In Sweden, because the public sector intervene to support and protect the motherhood, and supply the public daycare centers, they were closed to the Socialism Feminism’s point of view. Besides, Sweden government played a more active and positive role in encouraging both men and women to take the responsibility of childcare than Taiwan government did.

　　In brief, the real difference in the contents and practicing divergences of the Motherhood Protection related laws between Taiwan and Sweden’s institutions is that: Sweden had social common sense first and then leaded to the legislation. But Taiwan, in contract, had legislation first and then tried to build the new social conscience. This difference caused the discrepancy of the contents and practicing in the related institutions between Taiwan and Sweden.
