現今環境風險與日俱增，環境保護之意識也越趨高漲，同時，環境污染之特殊性又考驗著傳統究責制度的運行，致使立法朝加重污染者責任之方向挪移。為因應環境責任風險增加之趨勢，及環境外部成本內部化之實現，財務擔保制度可確保一定之清償能力，使其存在之正當性基礎得以確立。
本文以責任保險為研究之中心，探討其作為擔保制度之適切性，及潛在之限制。本文從風險層面及制度功能探討其作為擔保制度之適切性，亦認為保險市場理論上可以有效分配環境損害之成本，並提供激勵措施及控制風險，以防止對環境污染賠償責任卸責之行為。惟環境污染的可保性等因素，則可能增加保險之經營風險，為建構環境責任保險之潛在限制。
國外環境責任保險制度之發展已行之有年，而我國環境責任保險制度之發展尚處於起步階段，目前僅少數法規獎勵或要求特定業者投保相關之險種，其餘相關污染防治法，均欠缺明文規定。目前環保署所研擬之環境損害責任法草案，已有規範環境損害強制責任保險之相關內容，並於近期協助業者推出加油站環境責任保險保單。
保險市場之健全有助於風險之轉嫁與控制，保險契約之建構為其關鍵之處。過去美國責任保險承保污染責任經常引發諸多爭訟，本文亦探討該國實務之爭點，並檢視現行我國環境責任保險契約可能產生之爭議，以對我國環境責任保險之建構提出相關建議。

This article shows that it is necessary to establish a financial Assurance mechanism to deal with the huge costs that may be incurred after the accident when the risk of environmental pollution increases gradually.
And it focuses on liability insurance and discusses its suitability as a guarantee system from the perspective of risk and system function. In theory, the insurance market can effectively allocate the cost of environmental damage, and provide incentives and risk control to prevent liability abrogation. However, some factors such as the insurability of pollution may increase the operational risk of insurance, which is the potential limitation of environmental liability insurance.
This article discusses the development of environmental liability insurance and financial assurance requirement in different countries. Environmental liability insurance has been developed for many years in many countries, while Taiwan’s environmental liability insurance is still in its infancy.
In the past, liability insurance often caused many disputes when underwriting pollution liability in the United States. As a result, disputes arising from the practice of underwriting pollution risks in the American insurance market are discussed in this article as well. Finally, in order to put forward relevant suggestions on the construction of environmental liability insurance, this article also reviews the disputes that may be caused by the current environmental liability insurance contract in Taiwan.
