  • 創意產業CI(Creative Industry)乃源於個體創意、技巧及才能的產業,通過智慧財產權的生成與利用,而有潛力創造財富和就業機會。其中創意、技巧或才能的轉化過程經常涉及專利權,許多創新商業方法、創新產品等均需透過專利制度尋求保護。在專利制度中,任何發明均須透過專利說明書表達其發明內容並界定其申請專利範圍,本研究主要是建立一專利說明書評核表,以供評核專利說明書合於規範之程度。本研究先根據中華民國現行專利法、專利法施行細則、專利審查基準、智慧財產培訓學院之教材、專利相關文獻與專家訪談之結果,將與專利說明書有關的規範條列出來,然後該條列的規範結合一重要性選擇表製作成一問卷表,再以該問卷表對多位資深專利工程師與專利審查官進行問卷調查,並根據調查結果換算每一規範項目之權重分數,據以建立專利說明書評核表。本研究邀請三名接受過專利說明書撰寫課程之人員,在提供其相同參考資料之條件下,使其就同一主題撰寫專利說明書,然後以本研究建立之專利說明書評核表對所有撰寫作品進行評核;另請三位資深專利工程師對該撰寫作品進行人工評核,然後比對專利說明書評核表之評核結果與人工評核結果間之差異,據以做成專利說明書評核表是否可行之結論。

    The creative industry is an industry sourced from individual creativity, skills and talents, and has the potential of creating wealth and employment opportunities through generation and utilization of intellectual property rights (IPR). The conversion process of creativity, skills and talents often entails IPR, and many innovative commercial methods and innovative products require protection of the patent system. In the patent system, any invention has to be expressed and defined with claims. This research mainly aimed to establish the patent specification evaluation sheets to facilitate evaluation within the framework of the patent specification. This research was based on the current ROC Patent Law, the Enforcement Rules of the Patent Act, the Patent Examination Standard, teaching material of the Taiwan Intellectual Property Training Academy, relevant patent documents, and opinions of interview with experts. The relevant regulations for the patent specification were listed out and integrated with an important selection chart to produce a questionnaire for surveying survey a number of senior patent engineers and patent examiners. The survey results were then used to weight each regulation item for building the patent specification evaluation sheets. This research provided three writers who have received the patent specification writing course with identical reference information for them to write a patent specification of an identical theme. The established patent specification evaluation sheets were then used to evaluate the written specifications. In parallel, three senior patent engineers were invited to carry out manual evaluation. Afterwards, the evaluation results from the two processes were compared to verify the feasibility and validity of the patent specification evaluation sheets.
