航空器的失事常造成生命與財產的重大損失,亦嚴重損及國家形象,故世界各國均十分重視飛航安全。航空器維修是維繫飛安的基本條件,在廣體商用客機的問世後,航空器之承載量與飛航自動化趨高,航空器維修的複雜與困難度亦隨之提高;我國近年來失事事件頻傳,CI611飛航事故調查事實資料顯示該事故為空中解體,航空器維修問題再一次受到重視,民航主管機關監督與管理民用航空器之維修作業所必須具備的法源,亦應再次檢討以提高管理效能。
本論文參考比較ICAO Annex 6, 8.7、FAR part 145、JAR-145、CCAR-145AA與我國【航空器維修廠所設立檢定規則】進行比對分析。分析結果顯示新版的part 145在結構上最為完整,其內容詳細規範各類維修人員的資格與權力,以及維修廠的運作規則;JAR-145在品質系統上規定獨立的稽核單位與回報系統,法規僅在合格人員資格把關,且因為涉及歐盟各國主權,故法規內容具備較大的彈性。CCAR-145AA有明確的章節劃分,條文內容簡單扼要,特別強調維修廠手冊之規範。我國【航空器維修廠所設立檢定規則】編排結構較不明確,有重整的必要,其中對於管理人員與簽放人員的資格與責任、各類人員訓練之內容、各類紀錄的內容與維修廠手冊等相關規定仍有加強之空間,以提高法規之明確性。
本論文比較分析後,建立合理的維修廠法規結構共六部分,並提出法規結構上與內容上的建議事項如下:
一、採取國際上相同的編排方式,建立多層次的法條結構;
二、增加法規與法條的相互索引;
三、增強民航通告之內容以補強法規之解釋;
四、增加維修廠負責人的規定,加強管理人員之權力與責任;
五、取消維修廠所維修員規定,但需加強督導維修廠訓練計劃與訓練紀錄;
六、強調簽放人員的規定,須取得民航局證書並經合格維修廠授權放行航空器;
七、強調維修廠手冊的規定,不是包含於檢驗手冊中;
八、加強維修人員之訓練計劃與訓練紀錄的規定;
以期消弭目前【航空器維修廠所設立檢定規則】較不明確與混淆的部分,提高管理效率,同時和國際維修相關法規接軌及符合我國國情,使我國維修相關法規更為周全。
Aircraft accidents usually cause heavy loss to both life and property. It may even damage the image of a country. Therefore, serious attention was paid to flight safety throughout the world. One of the basic criteria to retain flight safety is a sound maintenance work that became more and more complex and difficult since the wide-body jet had come to the market. According to the factual report of ASC, recent accident of in-flight breakup of CI611 may closely relate to defective maintenance work. The importance of aircraft maintenance is raised once again, and the rules and regulations to manage the aircraft maintenance for civil aviation transportation require revise as well.
This thesis research compares and analyze ICAO Annex 6 Part 1 8.7, FAR part 145, JAR-145, CCAR-145 and CAR 06-02A, the regulations of repair station in order to conclude suggestions to improve CAR 06-02A. Results show that the latest version of FAR part 145 (draft) is more complete in structure. FAR part 145 (draft) also provides more detail requirements of personnel as well as more detail operation rules for a repair station. JAR-145 requests independent audit and a feedback reporting system for the quality system of a repair station. It presents more flexibility than the others to accommodate the individual authority of the contracting countries. CCAR-145AA has clearer structure than CAR 06-02A and paid particularly attention to the maintenance organization’s manual. Although CAR 06-02A basically follows the contents of an older version of FAR part 145, the analyses show that is necessary for CAR 06-02A to be re-organized. Enhancement of the articles to describe the requirements of supervisors, authority to release to service, personnel training content, record keeping, and manual of maintenance organization are also necessary. To improve our CAR06-02A, the thesis concludes with the following suggestions:
1.conform to the same structure of the referred regulations;
2.add indices between articles and between regulations;
3.enhance the contents of Advisory Circular in order to complete the necessary explanation of regulations;
4.add the description of the power and responsibility of accountable managers and supervisors;
5.delete the rules and regulations to certify repairmen, however, more intense supervision on training programs and training record keeping;
6.add regulation to request personnel to approve an article for return to service to have both certification of CAA and authorization by AMO;
7.clarify the requirement of the manual of maintenance organization;
8.clarify and enhance the requirement of personnel training programs and training records
