近年來全球智慧裝置處於高成長、高競爭的態勢，專利訴訟案數量快速增長特別在智慧裝置產業內，智慧裝置業者逐漸開始改變競爭上的策略，不同以往採取創新功能競爭，而是改採用訴訟手段來抵制對手使對手損失慘重，故如何利用專利佈局與訴訟策略來提升市佔率或如何做好防禦訴訟策略來減少企業損失，儼然已成為目前企業所重視的一大課題，亦為本研究之動機，一件專利訴訟案往往並不如同看似下的簡單，其中牽涉到許多商業與訴訟策略上的考量，而分析與釐清這些策略的運用現況、歸納出智慧裝置廠商可能沒有完全意識到卻需要注意的專利權課題，此為本研究之目的。
故本研究透過整理訴訟個案來發現待釐清的問題，並配合質性分析國內各大報章雜誌與數位時代雜誌來建構出目前產業內的專利佈局、專利訴訟與策略運用現況，最後是配合專家訪談與所整理的訴訟個案來驗證本研究的階段性研究成果，並也配合專家訪談來解決未有確切答案的待釐清問題。
研究成果可以分為兩個部分，首先為本研究所建構出目前智慧裝置廠商在專利佈局、專利訴訟與策略運用上之架構圖，透過此架構圖可以了解到企業因為競爭而面臨專利訴訟時，企業策略與專利訴訟之間互相影響與前後因果關係、第二部分為透過專家訪談釐清的待釐清問題，使我們了解到企業在專利訴訟上，不單單只是法律層面的考量，更多是企業策略上的選擇，專利訴訟的提告不完全都是由於其他業者侵犯了自身的專利，更多目的是為了要打擊對手或是減少企業的損失，最後還有透過後續討論章節補充本研究之衍生課題。

In recent years, the number of smart device around the world has been in high growth and high competition. The number of patent lawsuit case has grown rapidly especially for smart devices. Smart device companies changed its competition strategy. They use patent lawsuit to let competitor cause damage instead of innovation. It is important that the key point of company is how to use patent portfolio and strategy of lawsuit to raise market share and make defense strategy of lawsuit. This is the motivation of this research. It seems simple to just look at the patent lawsuit. However, it actually includes many strategy of business. To analyze these strategy of patent lawsuit, to clarify these issues as well as come to a conclusion that the device manufacturer may not noticed is also the purpose of this research.
This research firstly uses patent lawsuits and qualitative analysis to discover problems and analyze the content of newspapers and magazines, obtain the current situation of patent portfolio, patent lawsuit and patent lawsuit strategy. Secondly, this research use expert interviews and patent lawsuits to confirm theoretical saturated, respond our problems and examine our research results.
The result can be divided into two parts. The first part is the diagram which illustrate current situation of patent portfolio, patent lawsuit and patent lawsuit strategy in smart device companies. This diagram can realize about the interaction between business strategy and patent lawsuit. The second part is the conclusion of expert interviews which can realize whether the company wants to sue other company or not. It considers more about business strategy aspect than legal aspect. A company lawsuit arise not only because patent infringement but also because company can prevail through patent lawsuit or protect itself. Finally, our research has supplied some subsequent discussions about derivative issues.
