專利是高科技產業在經濟市場中競爭之重要策略,更是一個企業競爭力的重要指標。在眾多的專利相關研究中,大多數的文獻只單獨研究某項專利本身之價值或衡量鑑價方法的探討,但實務上不僅如此,公司往往將專利當作籌碼與競爭廠商取得交互授權協議,以減少研發費用的投資及謀取更高的利潤。本研究探討交互授權協議中兩方如何衡量效益,過程中決策者不但會考量專利產品帶來的利潤,而且也會關注專利技術的發展性,故交互授權的效益衡量和產品生命週期及專利技術的生命週期有極大的關聯。本研究以Bass擴散模式為產品擴散模式基礎,將技術擴散之概念導入其中,推導出整合技術型的產品擴散模式,進而發展整合技術型的產品生命週期,用以建立一個具備生命週期特徵的效益模式供決策者參考。利用本模式決策者將可以在不同時間,了解專利產品帶來的利潤以決定是否要進行交互授權。當決定交互授權後,雙方將進一步對專利進行鑑價,用以評估專利價值差異,接著再協議出雙方滿意的差額費用以完成協商。最後,本研究透過數值分析的方式,得到交互授權在成熟期階段利潤表現比不交互授權好的結論,可提供給決策者一個參考性的指標。
“Patents” have become a competitive tactic for a company in the High-Tech industry. It is also an important index for evaluating competitiveness of an enterprise. In most literature, researchers have investigated the value of patents or the valuating methods of patents. However, in practice, companies often consider patents as the chips to obtain cross-licensing agreement with their competitors. In fact, patents can reduce the R&D investment and can seek higher profits.
This research discusses how two companies measure the effects on the cross-licensing agreement. During the evaluation process, decision makers not only consider the profit from the patented product but also focus on the development of the patented technology. Therefore, the cross-licensing agreement has great relationship between technology life cycle and product life cycle.
There are many types of diffusion model. This research will focus on the most famous Bass diffusion. Based on Bass diffusion, this research introduces the technology diffusion to expand the tech-integrated product diffusion model, and then develop a tech-integrated PLC. Through these, we will set up the effects with life cycle characteristic for decision maker.
By this model, decision makers can understand the profits that patented product brings at the different time, and they can determine whether cross-licensing agreement can be conducted or not. After the decision is made to have cross-licensing, both companies will further measure the difference of patent’s value by valuating patents and then to agree the satisfied difference expenses to complete this agreement.
Finally, through numerical analysis, the major finding of this research is that conducting cross-licensing agreement can earn more profits on mutual stage than non-cross-licensing agreement.
