無人駕駛航空器系統(Unmanned aircraft systems,UAS)是台灣軍方隨著世界軍武潮流,成軍於民國100年的「戰術偵搜大隊」(Army Tactical Reconnaissance Group,ATRG),然面對無人飛行系統的發展與未來的兵力配置、數量增長,台灣的空域使用率勢必形成一明顯的壓縮,而造成飛安的隱憂。
目前國軍服役的UAS在飛航管制上是採空域申請及時段管制的方式來執行任務的,然台灣地狹人稠,就國軍龐大的訓練需求與民間各類航空器的成長双擊下,UAS若想擁有比照有人飛行載具的空域使用權,就現行法規立場,民航局是很難完全認同與接受的,是故要如何適切研改相關條件與制定規範作法則是本論文研究的核心目標。
為符合國防需求,本論文研究是以我國現行民航法規為研究基礎,分析國外相關意見及台灣環境限制,探討UAS未來在航空業發展與安管措施的研改作法,希透過本研究在錯綜複雜的飛航環境空間與法規限制下,以收集、歸納、比較、分析等方法,並加入當代科技技術以提升UAS性能,再以個人觀點整合理念,研擬出一套合理可行又能符合未來潮流所需的適航法規,創造出安全且優質的飛航環境,已達到能與「載人飛行器」共存共享空域資源。
The Army Tactical Reconnaissance Group (ATRG) was established in 2011 by the Taiwanese army following the global trend of arms of developing unmanned aircraft systems (UAS). However, to face the development of the UAS in future arrangement of army forces and expansion in the number troops, the usage rate of airspace in Taiwan will definitely get higher and may lead to the concern of aviation security. The air traffic control for the unmanned aircrafts currently serving in the national army to execute their tasks requires applications for airspace and access control based on time periods. Yet, Taiwan is a densely populated small country. With a lot of training related demands from the army and the growth of various civil aircrafts, it is difficult for the CAA to authorize unmanned aircrafts to have the same airspace usage right as manned aircrafts based on the current laws and regulations. Thus, this study focuses on how to appropriately modify related conditions and draw up related regulations.
To meet the national defense demands, this study uses the current Civil Aviation Law of the Republic of China as the research basis to analyze related opinions from other countries and environmental limitations in Taiwan, in order to explore the future development of UAS in the aviation industry and to adjust the security management measures. Under the complex limitations of airspace and regulations, a set of reasonable and feasible airworthiness regulations are expecting to meet future needs based on the results from this study. The proposed methods such as collection, induction, comparison, and analyses, plus modern technologies are adopted to improve UAS performance. Some personal view points are suggested in this study. The purpose of creating a safe and high-quality aviation environment can be fulfilled in achieving the goal of coexisting and sharing airspace resources with “manned aircrafts”.
