建築物公共安全檢查申報制度，係源於民國84年建築法第77條修正，此項立法改變以往政府在建築物安全檢查的角色，並強化建築物所有權人或使用人維護建築物安全之義務，對於建築物安全起了「積極」作用。本研究透過行政法院判例及專家訪談與申報人問卷之交叉比對，發現影響申報制度落實之主要原因為，對於場所動態未能有效掌握、各目的事業機關橫向聯繫不足、不合格場所未能積極落實改善、各項建築許可與檢查項目未能整合等，並建議透過上下游法規整合、共享資訊平台建立、不合格場所增加保險機制及建築技術規則增訂檢查專篇等，以落實建築物檢查申報制度，並促進整體建築物公共安全檢查執業環境之健全發展。

The building public safety inspection and declaration system is derived from the amendment of Article 77 of 1995 Building Act. This legislation changes the role of the government in building safety inspection and strengthens the obligation of building owners or users to maintain the safety, which plays a “positive” role in building safety. Through the cross comparison among administrative courts’ cases, expert interviews and applicants’ questionnaires, this study found the main reasons affecting the implementation of the declaration system are failure to integrate various building permits and inspection items, failure to effectively know the site status, lack of horizontal ties among institutions and government organs with various targets and failure to actively implement and improve the system in unqualified sites. Moreover, this study suggested integrating upstream and downstream laws, building shared information platforms, setting insurance mechanisms in unqualified sites and adding special inspection regulations to construction technology rules, so as to implement the building inspection and declaration system and to promote the sound development of the overall practice environment for building public safety inspection.
