  • 本文發現,因網路平台的出現影響言論傳播的數量與方式,故網路言論市場與網路興起前的傳統言論市場在許多方面皆有所不同。然而,政府並未針對網路言論市場的特性對現行監管假訊息的措施進行足夠修正,因此現行政府的作為並無法有效解決網路平台上的假訊息問題。
    本文透過學理分析,並參照美國、歐盟、德國三個實體監管網路假訊息的相關法規,提出政府面對網路平台上的假訊息問題時,應如何對網路平台使用者、網路平台、新聞媒體、政府本身實施新措施,使政府在有效監管網路平台上假訊息的同時,不會過度侵害人民的言論自由。

    Facing the problem of misinformation and disinformation on digital platforms, this paper finds that the marketplace of ideas online is quite different from the traditional marketplace of ideas before the rise of the Internet in many aspects. In particular, the emergence of digital platforms has changed the amount of dissemination of speech and the way in which speech is disseminated. However, the government does not adequately regulate and act on the characteristics of the marketplace of ideas online. Therefore, the current government regulations and actions cannot effectively solve the problem of misinformation and disinformation on digital platforms.
    In this regard, through theoretical analysis and with reference to the relevant laws and regulations of three entities including the United States, the European Union, and Germany to control online misinformation and disinformation, this paper proposes that when the government faces the problem of misinformation and disinformation on digital platforms, the government should implement new measure for internet platform users, internet platforms, news media, and the government itself, so that the government can effectively control misinformation and disinformation on digital platforms without unduly infringing on people's freedom of speech.
