本論文之目的係希望藉由所蒐集到之國外之民航法與我國現行之民航法進行相互比較與分析,提出一份改善我國民航法相關之建議。此外,本論文亦針對空中交通管制民營化蒐集相關資料,藉以提供我國飛航服務總台民營化所需之基本考量。
在美國飛安評鑑小組來台提出改善建議以及行政程序法的施行下,我民航法須進行有效之修訂整理。本論文蒐集美國典範民航法(Model Law)、大陸之民用航空法,和我國民用航空法進行比較,歸納完成一完整之民用航空法所應含之十二項重點,並根據此十二項重點深入分析相關法條內容。研究顯示我民航法在民航局之職權、航空器之國籍與所有權、航空站及助航設備之最低安全標準、空中交通管制、運輸保安相關事項、罰鍰等部分仍有改善空間。本論文亦整理我國民航法與子法(規則、規定等)間之邏輯依據,並針對航空安全檢查制度提出補充意見。故本論文或可作為民航局下次修法之參考,使我民航法趨於完備。
近代為改善空中交通誤點等狀況,許多國家相繼投入空中交通管制民營化之研究,期望透過民營化增進空中交通管制之效率。本論文根據相關文獻整理出空中交通管制民營化考量之初步評估事項,並整理出六種民營化模式以供參考。依據飛航服務總台之年度收支資料分析,我飛航服務總台民營化須重新評估機場服務費、場站落地費及飛航服務費之收費分配標準,以建立民營化後之財務基礎,期使民航局人事精簡,職權更趨明確。
This thesis has been focused on two major issues. One is to propose a recommendation of strengthening the content of Chinese Civil Aviation law by comparing the differences between the US Model Law, Civil Aviation Law of Mainland China and the current Chinese Civil Aviation Law. The other is the feasibility study of the privatization of Air Navigation and Weather Services (ANWS) in the future. The data collected has been analyzed for the preliminary evaluation of the privatizing action.
According to the report of IASA and Administrative Procedure Act, Chinese Civil Aviation Law needs to be amended. After comparing Chinese Civil Aviation Law with Model Law and Civil Aviation Law of Mainland China, a conclusion has been reached that there are twelve crucial parts need to be incorporated into the Civil Aviation Law for a completely comprehensive version. The study has shown that the parts of enforcement of power and duties of CAA, nationality and ownership of aircraft, airports and air Navigation facility safety standards, air traffic control, air transport security, and penalties in the Chinese Civil Aviation Law require further clarification. The thesis has also looked into the correlations between the Civil Aviation Law and Regulations. The incompatibility between them has been sort out and listed. The recommendations on Air Safety Inspection have been presented as well in the thesis.
The goal of privatization is to enhance the efficiency of the organization. Preliminary analysis on the privatization of ANWS has been performed. Six different models to privatize are presented in the thesis. By analyzing the data presented in CAA annual report, re-estimate the distributive ratio of airport service charge, landing charge and air traffic service charge is required so as to establish a healthy financial basis for the future privatization of ANWS.
